Any order validated by the consumer within the store www.souvenirs-paris.com implies prior acceptance of these general conditions.

1.2 - order validity
The consumer acknowledges being fully informed that their agreement on the content of these general conditions does not require a handwritten signature, as the consumer orders online the products presented therein.
The consumer declares having full legal capacity allowing them to commit under these general terms and conditions of sale.
1.3 - application of the general terms and conditions of sale
The consumer has the facility to save or edit these general conditions, it being specified that both saving and editing of this document are their sole responsibility, these conditions being liable to change by Souvenirs et Compagnie.
In this case, the applicable conditions will be those in force on the site at the time of the consumer's order validation.

1.4 - contractual information
The online store set up by Souvenirs et Compagnie as part of its website mentions the following information:
- legal notice allowing precise identification of Souvenirs et Compagnie
- presentation of the essential characteristics of the goods offered
- indication, in euros (incl. taxes) of the price of the goods and, if applicable, the participation in shipping costs
- indication of payment, delivery, or execution modalities
- existence of a right of withdrawal
- the offer’s validity duration

All information on the site www.souvenirs-paris.com is presented in the French language.

1.5 - mutual obligations
These general terms and conditions of sale express the entirety of the obligations and rights of both parties. In this sense, the consumer is deemed to accept without reservation all the provisions of these conditions. Souvenirs et Compagnie commits to respecting its role as a reseller within the framework of these same conditions.

Article 2: General
2.1 - Purpose and entry into force of the general terms and conditions of sale
These general terms and conditions aim to define the rights and obligations of the parties in the context of the online sale of goods and services offered by Souvenirs et Compagnie to the consumer.

2.2 - contractual documents
This contract is formed by the following contractual documents, presented in descending hierarchical order:
- these general terms and conditions of sale
- the order form

In the event of a contradiction between the provisions contained in documents of different rank, the provisions of the higher-ranking document will prevail.


2.3 - duration
These general terms and conditions of sale come into force on the date of order or signature of the order form by the consumer.
These conditions are concluded for the duration necessary for the provision of the goods, until the expiry of their guarantees.

2.4 - validity of the electronic signature
In accordance with the law of March 13, 2000, on the electronic signature, any order form signed by the consumer by "double click" constitutes an irrevocable acceptance which can only be challenged in the limited cases provided for in these general terms and conditions of sale such as "right of withdrawal" and "out of stock".
The "double click" associated with the authentication, non-repudiation, and integrity protection of messages constitutes an electronic signature. This electronic signature has the value of a handwritten signature between the parties.

2.5 - transaction proof
The computerized registers, kept in the computer systems of Souvenirs et Compagnie under reasonable security conditions, will be considered as proof of communications, orders, and payments made between the parties.
Archiving of order forms and invoices is carried out on a reliable and durable medium that can be legally produced as proof.


Article 3: Products
3.1 - information
Souvenirs et Compagnie presents on its website www.souvenirs-paris.com the products for sale as well as their detailed descriptions, allowing compliance with Article L 111-1 of the Consumer Code, which provides the possibility for the potential consumer to know before the final order the essential characteristics of the products they wish to purchase.

3.2 - prices / VAT
The prices on the site are indicated in Euros including all taxes (incl. taxes). They are applicable when validating the order by the consumer and do not integrate the participation in shipping costs, charged in addition, and indicated before the final validation of the order form.
The prices are subject to French VAT and any change in the legal rate of this VAT will be implicitly reflected on the price of the products presented on the site www.Souvenirsdeparis.fr at the date stipulated by the application decree referring to it.

3.3 - availability
Availability deadlines are mentioned on the product sheets posted online on the site www.souvenirs-paris.com and are reported for each product inserted in the consumer's order form. Information on the availability of products, being transmitted by suppliers and/or manufacturers, definitive unavailability or possible postponement of these dates cannot engage the responsibility of Souvenirs et Compagnie, nor open the right to damages and interest for the consumer.

3.4 - validity of product offers
The offers presented by Souvenirs et Compagnie are only valid while stocks last. Souvenirs et Compagnie reserves the right to modify the assortment of products, their availability deadlines, and their prices, according to the constraints imposed by suppliers and/or manufacturers and to inform the consumer.

3.5 - conformity of product offers
The products offered comply with current French legislation and standards applicable in France. The photographs, texts, graphics, information, and characteristics reproduced and illustrating the products presented are not contractual. Consequently, the responsibility of Souvenirs et Compagnie cannot be engaged in the event of an error or omission in one of these photographs, texts or graphics, information or characteristics of the products, or in the event of modification of these said characteristics by the suppliers and/or manufacturers.


3.6 - mutual obligations
• 3.6.a: of the consumer
Total or partial impossibility to use the products cannot give rise to any compensation, reimbursement, or questioning of the responsibility of Souvenirs et Compagnie. Souvenirs et Compagnie cannot be held responsible for any prejudice whatsoever, resulting from a professional activity.

• 3.6.b: of the reseller
As part of a postponement of the availability of a product, Souvenirs et Compagnie will inform the consumer of the new dates in force announced by the suppliers and/or manufacturers. In case of prolonged unavailability of a product, Souvenirs et Compagnie will offer the consumer an equivalent replacement product or, failing that, cancellation of this product and its reimbursement, if applicable.

3.7 - transfer of ownership
Souvenirs et Compagnie retains full and complete ownership of the products sold until the full collection of all sums due by the consumer in the context of their order, including fees and taxes.
The transfer of ownership of a good purchased from Souvenirs et Compagnie by the consumer to a third party will not be taken care of by Souvenirs et Compagnie.
Only the original buyer of this good can claim access to the clauses of these general terms and conditions of sale.

Article 4: Order
 4.1 - order confirmation
Certain contractual information may be confirmed by email. Some orders will have to be checked by the verification service of Souvenirs et Compagnie. The consumer will be notified by email of the supporting documents to be sent back in order to obtain the final validation of their order. Souvenirs et Compagnie reserves the right to cancel the order in case of non-receipt of these documents or receipt of documents deemed non-compliant.

4.2 - consumer-related data
Any order paid by cheque or cash mandate will only be processed upon receipt and cashing of the payment method. Availability and shipping deadlines will have to be recalculated from the date of registration of this method of payment.
The consumer must check the completeness and conformity of the information concerning the delivery address that they provide to Souvenirs et Compagnie. The latter cannot be held responsible for any possible typing errors and the consequences that may result, such as a delay and/or an error in delivery. In this context, all costs incurred for the reshipment of the order will be entirely at the consumer's expense.

4.3 - order execution
The order will be recorded and processed within 48 hours following the full payment of the order, except in cases of force majeure or if the order was recorded before the weekend. In this case, the next working day will mark the start of the delay.
The consumer will be notified by email of the imminent dispatch of their order.
In case of any problem with the order, it will be executed at the latest within a period of 30 days from its final validation by the company Souvenirs et Compagnie (payment received and order verification procedure completed).

4.4 - Non-execution of the order
Souvenirs et Compagnie shall not be held responsible for the non-fulfillment of the contract concluded in case of stock shortage or unavailability of the product, force majeure, disruption, total or partial strike, particularly of postal services and transportation and/or communications, flood, fire.
Souvenirs et Compagnie shall not incur any liability for any indirect damage due to the present, loss of operation, loss of profit, loss of chance, damage or expenses, which may arise from the purchase of the products.
In case of unavailability of the ordered product, especially due to suppliers and/or manufacturers, the consumer will be informed at the earliest and will have the option to modify or cancel their order. The consumer will then have the choice to request either a refund of the amounts paid (occurring within 30 days at the latest following the date of cancellation of the order), or if applicable, an exchange for a product of equivalent characteristics and price, in agreement with Souvenirs et Compagnie
In case of impossibility of exchange, Souvenirs et Compagnie reserves the right to cancel the consumer's order and refund the amounts paid.

4.5 - Mutual obligations

• 4.5.a: of the consumer
Should the information provided by the consumer at the time of their order be incomplete or incorrect, Souvenirs et Compagnie shall not be held responsible for any resulting input errors or their consequences, particularly in terms of delay and/or error in delivery. In this context, all costs incurred for reshipping will be borne by the consumer.
As part of an order verification, the consumer must send to Souvenirs et Compagnie, by fax or email, a readable photocopy of an identity document and proof(s) of address. The order will only be validated after receipt and verification of these elements. Should these documents not be received within 15 days following the consumer's validation of the order, it will be deemed automatically cancelled.

• 4.5.b: of the retailer
Souvenirs et Compagnie commits to inform the consumer of any change occurring in their order concerning the delay, price, characteristics, to allow the latter to modify their order accordingly.

4.6 - Participation in shipping costs
Souvenirs et Compagnie will charge the buyer for shipping costs.
The amount of these costs will be indicated on the site when validating the order.

4.7 - Warnings / Advice
Souvenirs et Compagnie advises the consumer to keep a record of the data related to their order on paper or reliable digital support until the definitive resolution of their order, or until the end of the warranty period of the delivered products.


Article 5: Payment


5.1 - Validation
Checks, cash payments are cashed upon validation of the order by the consumer.
Credit card payments are subject to the same collection conditions except for specific and/or occasional payment offers proposed within the framework of the website www.souvenirs-paris.com.

5.2 - Method of payment
To pay for their order, the consumer has the choice of all the payment methods offered at the final validation of the order form, namely: PayPal- credit card, check, and cash mandate.
In case of payment by check, it must be issued by a bank domiciled in metropolitan France. Any order paid by check or cash mandate will only be processed upon receipt of payment. Availability and shipping times will be recalculated from the date of registration of the payment method.

5.3 - Full payment
Full payment must be made at the time of the order, except for a specific offer indicated on the site. At no time can the amounts collected be considered as deposits or down payments.
Souvenirs et Compagnie reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid a previous order, or with whom a payment dispute remains.
5.4 - Mutual obligations

• 5.4.a: of the consumer
The consumer guarantees Souvenirs et Compagnie that they have the necessary authorizations to use the payment method chosen at the time of order validation.

• 5.4.b: of the retailer
Souvenirs et Compagnie reserves the right to suspend any order management or delivery in case of refusal of payment authorization by financial organizations.
Souvenirs et Compagnie has implemented a procedure to verify orders to ensure that no one uses another person's bank details without their knowledge. However, the consumer is advised that Souvenirs et Compagnie cannot be held responsible for any malpractice or fraudulent use of any means of payment that was not detected by the verification procedure.

5.5 - Warnings / Advice
Souvenirs et Compagnie recommends the consumer to ensure the solvency of their payment before validating their order on the website www.souvenirs-paris.com. Souvenirs et Compagnie reminds the consumer that all credit card payments are made through a secure system and that no credit card number is stored in its files.

Article 6: Delivery


6.1 - Generalities
An order will be considered as settled when all the products have been shipped and the consumer has fully paid for the products and their shipping costs.

6.2 - Terms
The products will be delivered to the address indicated by the consumer on the order form.
The choice of the mode of transport will be up to Souvenirs et Compagnie depending on the weight and/or volume of the products.
Souvenirs et Compagnie reminds the consumer that they must ensure that all useful information for the delivery of their order has been provided.

6.3 - Usual reserves
The consumer has the legal and contractual obligation to check the physical state and the contents of the package(s) upon delivery, in the presence of the delivery person.
Any anomaly concerning the delivery (damage, product missing compared to the delivery note, damaged parcel, broken products, etc.) must be indicated on the delivery note of the carrier in the form of "handwritten reserves", detailed, dated, explicit, and accompanied by the consumer's signature.
The consumer must also report this anomaly by sending a registered letter with acknowledgment of receipt to the carrier within two (2) working days following the delivery date, exposing said claims.
The consumer must simultaneously send a copy of this letter (accompanied if necessary by the "damage report" or the "anomaly report" obtained from the carrier) by simple mail to: Souvenirs et Compagnie, Moulin de la Chaussée, MAULE 78 580.
Any claim received after the deadline will be definitively rejected without the possibility of recourse for the consumer.

6.4 - Mutual obligations

• 6.4.b: of the consumer
The consumer is responsible for ensuring the conformity of the delivery in the presence of the carrier, either by themselves or by a person authorized by them to receive this delivery.

• 6.4.a: of the retailer
Souvenirs et Compagnie will make every effort to regularize the situation with the carrier as long as the consumer has carried out all the required steps in case of anomaly during the delivery.
Souvenirs et Compagnie cannot be held responsible for possible delivery delays, particularly due to errors or disturbances attributable to carriers (total or partial strike of the logistics chain and/or postal services and/or means of transport or communications).

6.5 - Delays
In case of delivery delay by the Post within eight working days following the shipment date indicated in the email "tracking - shipment notice", Souvenirs et Compagnie suggests the consumer check with their post office if the package is not pending, and if applicable, invites them to report this delay by contacting the Customer Service primarily by phone or by sending an email. (cf. Art.12 - 12.9)
Souvenirs et Compagnie will then contact the Post to start an investigation. This Post investigation can last up to 21 working days from its opening date.
If during this period, the product is found, it will be redirected as soon as possible to the consumer's home. If, on the other hand, the product is still not located at the end of these 21 working days, the Post will consider the package as lost. Only at the close of this investigation will Souvenirs et Compagnie be able to send a replacement product at its expense. If the ordered product(s) were no longer available, the consumer could obtain a refund for the products concerned by the loss declaration confirmed by the carrier.

In case of delivery delay by other carriers within five to ten working days following the dispatch date mentioned in the "tracking - dispatch notice" email, the customer is invited to report this delay by contacting our Customer Service preferably by phone or email. (see Art.12 - 12.9)
The company Souvenirs et Compagnie will open an investigation with the concerned carrier to locate the package. If the merchandise is found, it will be redirected as soon as possible to the consumer's home. Otherwise, and after obtaining the loss report declared by the carrier, the company Souvenirs et Compagnie will either reship the product(s) or, in case of permanent unavailability, refund the consumer the amounts received according to the terms of these general sales conditions.

6.6 - anomaly / spoliation
In the context of a delivery made by La Poste, if the package arrives opened and/or damaged (especially with the presence of La Poste's yellow tape) and it is accepted upon delivery accompanied by "handwritten reservations", it is essential that the consumer obtains an "anomaly report" from the postman or the post office to which they belong. This form should be sent to the company Souvenirs et Compagnie so that they can open an investigation and initiate a compensation procedure, if applicable.
In case of refusal of this merchandise upon delivery and in addition to issuing "handwritten reservations", the consumer must ask the carrier to return this package to the company Souvenirs et Compagnie, accompanied by a "spoliation report" (report 170) and keep a copy of this form, if applicable.

In the context of a delivery made by other carriers, any opened and/or damaged package, whether accepted or not at delivery, must be accompanied by "handwritten reservations". These must be noted on the delivery slip by the consumer, who must also inform the carrier and the company Souvenirs et Compagnie by mail within two (2) working days following the delivery.
Some carriers will carry out an inspection at home to assess the condition of the delivered package before its removal and, if applicable, redirection to the after-sales service of the company Souvenirs et Compagnie, accompanied by a notification of incidence.

6.7 - warnings / advice
Only damages and anomalies mentioned in the said reservations issued by the consumer will be taken into account in resolving the dispute by the carrier.
The company Souvenirs et Compagnie reminds that in case of delivery issues, the consumer must imperatively keep all the elements received in their original state (packaging and over-packaging included) until the complete resolution of their file.
Any non-compliance with the rules defined above may result in the refusal of the carrier to take charge of the dispute.


Article 7: Receipt


7.1 - terms
The consumer must report to the company Souvenirs et Compagnie, within two working days following the date of receipt of the package, any claim of delivery error and/or non-conformity of the products in nature or quality compared to the indications on the order form. Any claim made beyond this period will be rejected without possibility of recourse for the consumer.

7.2 - delivery errors
In the case of a delivery not intended for them, the consumer is required to keep the package(s) as is and to inform, according to the procedures, the Customer Service of the company Souvenirs et Compagnie:

7.3 - non-conforming products
In case of non-conforming product, the consumer may file this claim according to the procedures, with the Customer Service of the company Souvenirs et Compagnie :

7.4 - reciprocal obligations

• 7.4.a: of the consumer
Any claim not made in accordance with the rules defined above and within the prescribed time limits cannot be taken into account and will release the company Souvenirs et Compagnie from any responsibility towards the consumer.

• 7.4.b: of the reseller
Souvenirs et Compagnie will do everything possible to regularize the problem encountered by the consumer as soon as possible. In these specific cases and to the extent that the error comes from its services, the company Souvenirs et Compagnie will take care of the return of the product(s) by the mode of transport of its choice.


Article 8: Right of withdrawal


8.1 - generalities
the company Souvenirs et Compagnie grants the consumer a withdrawal period of 14 calendar days to return, at their expense, the products that do not suit them. This period runs from the date of delivery of the product to the consumer.

8.2 - terms
Any return must be previously reported to the Customer Service of the company Souvenirs et Compagnie :
- by phone: 01 45 78 14 58, from 10 am to 4 pm without interruption from Monday to Friday, excluding public holidays.
- By email: info@souvenirs-paris.com

A return number will then be assigned to the product which must be returned to the after-sales service of the company Souvenirs et Compagnie. In all cases, the return remains at the expense and risk of the consumer.
This right of withdrawal is exercised without penalty, except for the return costs which remain at the consumer's expense.
In the event of the exercise of the right of withdrawal, the consumer has the choice of requesting either the refund of the amounts collected, or an exchange for an amount equivalent to the sums paid or, if applicable, with a bank supplement. The costs of reshipping remain at the expense of the consumer.

8.3 - reciprocal obligations

• 8.3.a: of the consumer
Any product subject to a withdrawal by the consumer must be returned to the company Souvenirs et Compagnie, in new condition and suitable for resale.
Any product that has been damaged, that is incomplete, or whose original packaging is deteriorated or absent, will not be refunded or exchanged.

• 8.3.b: of the reseller
In case of exercise of the right of withdrawal, the company Souvenirs et Compagnie will make every effort to reimburse the consumer within a period of 15 days following receipt of the return. However, given the specific nature of the products sold, this period may be extended to 30 days, especially when the product requires technical verification by the after-sales service of the company Souvenirs et Compagnie (these products must be tested in all cases).
The consumer will then be reimbursed by bank cheque.

8.4 - special cases
Products such as software, discs, CD-ROMs, films, prepaid telephone cards... must not have been unsealed, so that the consumer can benefit from the right of withdrawal.

8.5 - warnings / advice
the company Souvenirs et Compagnie recommends to the consumer to return their products with a recommendation or additional insurance guaranteeing, if necessary, compensation for the products up to their actual market value in case of spoliation or loss of these packages.
Any right of withdrawal exercised after the authorized fourteen (14) days will be refused by the company Souvenirs et Compagnie, the delivered products will be deemed to conform to the order and accepted by the consumer.
The company Souvenirs et Compagnie recommends to the consumer to overwrap the original packaging of their products, as only products returned in their entirety (accessories, warranty coupon, drivers, manuals, cover, etc.), in their original packaging, the whole being intact and in perfect condition for resale, will be taken back.


Article 9: Returns


9.1 - generalities
Any return of a product must be subject to the prior agreement of the company Souvenirs et Compagnie and comply with the conditions required by the after-sales service.
Without prior agreement and/or compliance with the return conditions, any package will be refused by the company Souvenirs et Compagnie and returned at the sender's expense.

9.2 - terms
Upon receipt of the claim, the company Souvenirs et Compagnie will assign a return number to the product(s) concerned and communicate it to the consumer. The return of a product can only take place after the assignment of this agreement number valid for eight (8) working days. In case of delivery error or non-conforming reception and depending on the weight or volume of the product(s) concerned, the consumer will return the product(s) at the expense of Souvenirs et Compagnie.

Any product to be exchanged or refunded must also be returned to Souvenirs et Compagnie within eight (8) working days following the return agreement and must be returned in its entirety (accessories, warranty coupon, instructions, etc.), in its original packaging and in perfect condition, to the address:

The return number granted must be visibly indicated on the return packaging and the return slip must be printed and slipped inside the package.

9.3 - warnings / advice
Any return must be reported in advance to the Customer Service of Souvenirs et Compagnie.
Failure to comply with the aforementioned procedures will result in no claim for non-conformity or apparent defect of the delivered products being accepted.

9.4 - conditions for refunding return costs
If the consumer has not used the prepaid label that will be sent to them, Souvenirs et Compagnie reserves the right to reimburse or not the shipping costs incurred by the consumer. Any request for reimbursement must be made by the consumer with proof and within the limit of the cost of a colissimo shipment with insurance, if necessary. Requests that may be accepted by Souvenirs et Compagnie will only be so if the latter's responsibility is involved and if the returned product corresponds to the original declaration made by the consumer and confirmed by the after-sales service.

Article 10: Product Warranty


10.1 – terms
Souvenirs et Compagnie informs the consumer that most suppliers require keeping the original packaging to be covered by the warranty.
Souvenirs et Compagnie will refuse any return of a product deemed covered by the on-site or direct manufacturer warranty.
In the case of a defective product during the warranty period, the consumer is invited to contact customer service, which will indicate the procedure for returning their product. No return will be accepted without prior agreement materialized by the issuance of a number and a return agreement slip. This return agreement is valid for a duration of 8 working days. From its attribution, the defective product must be returned to Souvenirs et Compagnie in its original packaging, complete (accessories, warranty coupon, instructions, etc.), the whole protected by an overpackaging mentioning visibly the return number communicated by Souvenirs et Compagnie, the printed return slip must be included in the package.

10.2 - generalities
In accordance with Article 4 of Decree No. 78-464 of March 24, 1978, the provisions of these general sales conditions cannot deprive the consumer of the legal warranty that obliges the professional seller to guarantee them against all consequences of hidden defects in the sold item. This clause is only applicable in the context of a complete settlement of the order.
Souvenirs et Compagnie reminds the consumer that an after-sales service treatment can last on average between four (4) and eight (8) weeks.

10.3 - conditions
The conditions and duration of the manufacturer's warranty are those indicated on the product sheets presented on the site at the time of ordering and possibly on the warranty slip included with the product(s).

10.4 - mutual obligations

• 10.4.b: of the consumer
All costs and risks associated with the return of the defective product are borne by the consumer.
The consumer is required to return their product accompanied by the warranty coupon, which may be mandatory in the context of a repair under warranty.

• 10.4.a: of the reseller
Souvenirs et Compagnie guarantees the consumer, for hidden defects that may affect the delivered products, in the context of replacing defective products, or parts making them unfit for their use, or their refund, without being considered by the consumer as responsible for any harmful consequences that these hidden defects could have caused.

10.5 - special cases

10.6 - out of warranty
Any product whose warranty period has expired will not be supported by Souvenirs et Compagnie.

10.7 - warnings / advice
The consumer is expressly informed that Souvenirs et Compagnie is not the producer of the products presented within the framework of the website www.souvenirs-paris.com, within the meaning of Law No. 98-389 of May 19, 1998, and relating to the liability for defective products.
Consequently, in the event of damage caused to a person or property by a product defect, only the producer's responsibility can be sought by the consumer, based on the information on the product's packaging.

Any product whose failure results from negligence, mistreatment, or inappropriate use (disrespect of the instructions for installing and operating the product, falsification, etc.), will irreversibly cancel the manufacturer's warranty. In this specific case, the product can be returned to the consumer as is, or repaired upon acceptance and prior payment of an estimate established by the manufacturer.

Article 11: Residents Outside Metropolitan France

11.1 - generalities
Any order will be invoiced all taxes included (TTC) and only consumers meeting the conditions required to benefit from a tax exemption, will be refunded the corresponding French VAT for the product(s) ordered.
Any request related to tax exemption and/or intra-community VAT must be formulated by the consumer after invoicing the product(s) referring to it.

11.2 - export sales slip

• 11.2.a: generalities
The consumer residing outside the European Union and DOM, and wishing to benefit from a tax exemption, can make a request for an export sales slip from our services
The price calculated and mentioned on the invoice will be all taxes included (TTC). The goods that can be tax-exempted are those purchased by the consumer for their personal needs and the total amount of their purchases must be equal to or greater than 175.00 euros (TTC) excluding shipping costs and/or service offers and/or promotional offers.
We invite the consumer to read and check beforehand the essential conditions, to benefit from the exemption from French VAT, by the following link.

• 11.2.b: terms
If the consumer meets all the conditions required by customs, they must make their request for an export sales slip from our services, by phone or by mail.
The consumer must provide certain supporting documents before Souvenirs et Compagnie. Issue them the tax-exempt form: readable double-sided copy of an ID (passport, residence permit, consular card, etc.), handwritten declaration of honor (identical to the model that will be communicated by our Customer Service) and, if necessary, accompanied by a proof of residence abroad.
After returning the pink section stamped by customs within 3 months following the purchase, the consumer may obtain from Souvenirs et Compagnie the restitution by check of the VAT amount of the product(s) concerned. The time before dispatch of this refund will vary between four (4) and six (6) weeks upon receipt of the pink section stamped by customs.

• 11.2.c: conditions
Souvenirs et Compagnie reserves the right to refuse any request for tax exemption that does not meet the conditions required in these general sales conditions and those required by the customs services.
Service offers and/or promotional offers likely to be proposed by Souvenirs et Compagnie, as well as contributions to shipping costs, will not benefit from any possible tax exemption.

• 11.2.d: warnings / advice
Souvenirs et Compagnie reminds the consumer that the billing address mentioned during their order must be located in a state or country not a member of the European Union, in order to obtain, if necessary, an export sales slip.

11.3 - intra-community VAT

• 11.3.a: generalities
All residents of the European Union will be invoiced the amount of French VAT at the time of validating their order.

• 11.3.b: terms
- If the consumer is an individual or an entity not subject to VAT, they must pay the prices indicated all taxes included (TTC) on the website www.souvenirs-paris.com of Souvenirs et Compagnie (including shipping costs, if applicable).
- If the consumer is an entity subject to VAT (in particular non-French companies of the European Union), they must send to Souvenirs et Compagnie a reminder of their order on company letterhead, explicitly mentioning the company's intra-community VAT number.

Upon receipt of this document and after verification of the intra-community VAT number, a tax-exempt invoice will be sent to the taxable entity as well as a refund by check of the VAT amount corresponding to the invoiced products.

• 11.3.c: conditions
Souvenirs et Compagnie reserves the right to refuse any request for tax exemption that does not meet the conditions required in these general sales conditions and those required by the customs services.

• 11.3.d: warnings / advice
The company Souvenirs et Compagnie reminds consumers that it is imperative to have a valid intra-community VAT number in order to obtain, if applicable, a tax-exempt invoice and the reimbursement of French VAT for the ordered products.
The consumer must mention during their order, a billing address located in a state or country that is part of the European Union.

11.4 - special cases
In the context of relocating an order or a product to a country other than metropolitan France, Souvenirs et Compagnie reminds consumers that they remain the importer of the product(s) in question. Any customs duties, other local taxes, import duties, or state taxes that may be due are not the responsibility of Souvenirs et Compagnie. It is the consumer's responsibility to check with local authorities for the possibility of importing or using the products they plan to purchase.

11.5 - reciprocal obligations

• 11.5.a: of the consumer
It is the consumer's full responsibility to inquire with local authorities and assume the burden of declarations and corresponding payments to the competent authorities and bodies of the concerned country.

• 11.5.b: of the reseller
Souvenirs et Compagnie cannot be held responsible in case of non-compliance with the legislation of the country where the products are shipped by the consumer.

11.6 - participation in shipping costs
Souvenirs et Compagnie will charge shipping costs to consumers residing in France and outside metropolitan France. (see Art 4 - 4.6)
11.7 - warnings / advice
Souvenirs et Compagnie reminds consumers, who wish to obtain an export sales slip, that it is imperative that their billing address is located in a country or state outside the European Union and eligible for tax exemption.
Souvenirs et Compagnie reminds consumers with a VAT status, that it is imperative that their billing address is located in a European Union country.


Article 12: Legal Notices & Legal Clauses


12.1 - force majeure
Neither party will have failed in their contractual obligations, insofar as their execution is delayed, hindered, or prevented by a fortuitous event or force majeure.
Considered as a fortuitous event or force majeure are all facts or circumstances that are irresistible, external to the parties, unpredictable, inevitable, independent of the will of the parties, and that cannot be prevented by them, despite all reasonably possible efforts.
The affected party will notify the other within ten working days following the date on which they became aware of it.
The two parties will then come together, within a month, unless prevented by the force majeure, to examine the impact of the event and agree on the conditions under which the contract's execution will continue. If the force majeure lasts more than three months, these general conditions may be terminated by the aggrieved party.
Expressly considered as cases of force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of the French courts and tribunals are:
- the blocking of means of transport or supplies, earthquakes, fires, storms, floods, lightning
- the stoppage of telecommunication networks or difficulties specific to the external telecommunication networks of the clients.

12.2 - links
Hypertext links may refer to sites other than that of Souvenirs et Compagnie.
Souvenirs et Compagnie disclaims all responsibility if the content of these sites contravenes the legal and regulatory provisions in force.

12.3 - partial non-validation
If one or more stipulations of these general conditions are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations will retain their full force and scope.

12.4 - non-waiver
The fact that one of the parties does not take advantage of a breach by the other party to one of the obligations referred to in these general conditions shall not be interpreted for the future as a waiver of the obligation in question.

12.5 - title
In case of difficulty in interpreting between any of the titles at the head of the clauses, and one of the clauses, the titles will be declared nonexistent.

12.6 - applicable law
These general conditions are subject to French law. This is so for both substantive and procedural rules.
In case of dispute or claim, the consumer will first contact Souvenirs et Compagnie to seek an amicable solution.
